Item Conditions and Guarantees

We do our best to accurately describe items. If stock photos are provided, they are for representation purposes only. If you receive an item you believe was not as described please contact us and we will do our best to make it right.

Item conditions include: Factory Sealed/Brand New, Appears New, Open Box, Damage and Salvage.

• Factory Sealed/Brand New:New in box, never used. 48 Guarantee applies.
• Appears New:May or may not be in original box. No apparent signs of prior usage. These items should function as expected. 48 Guarantee applies.
• Open Box:These items could be incomplete, used, missing parts or instructions. These items are not tested for functionality unless listing detail states differently. Items are sold AS-IS. No returns or refunds.
• Damage:Items appears to be complete with cosmetic damage including dents, dings, scratches, etc. These items are sold AS-IS. No returns or refunds.

Guarantee:Items sold as Factory Sealed/Brand New or Appears New will be guaranteed to be as described. If your item does not match the description you have 48hrs from pick up to notify us. We reserve the right to exchange the item or issue a refund at our discretion. Guarantee applies to description/functionality only. All other listed conditions are sold AS-IS and no exchanges/refunds will be given.

This is an online-only auction bound by all legal rights and remedies in the state in which the auction occurs. Do not bid if you cannot agree to the terms of this contract or are not able to pay and pick up your items within the specified terms of each auction. Auction-specific terms and conditions for this affiliate are as follows.

Inspection: This auction does offer scheduled inspection dates. To schedule an inspection, you must contact us DURING our business hours a minimum of 24 HOURS before the auction closes. If you are unable to schedule an in-person inspection, we inspect the item(s) for you and answer your questions to the best of our ability.

Payment: The default credit card on file with your account will be charged within 24hrs following the close of the auction. If your payment is declined for any reason, you will not be able to pick up your items without paying. If you are tax exempt, please contact us, including your bidder ID, DURING our business hours BEFORE the auction closes. To receive tax exemption, you are required to provide the proper documentation BEFORE we adjust your invoice. Any invoices won BEFORE documentation is provided and approved will NOT be adjusted.

Invoices over $2,000 are not able to be paid by the credit card you have on file. You will need to pay with cash. If you, as the winning bidder (Buyer), do not provide sufficient funds or fail to retrieve your item(s) within the scheduled pick-up times, you may incur fees. Multiple instances of not paying or retrieving your items will result in a permanent block from the Equip-Bid site. Any bidder caught opening a new account will be charged an additional $50 with the above warnings. This is considered fraudulent bidding and is not tolerated.

Pick-Up: If you are unable to pick up your items during the scheduled pick-up times, do not bid. By bidding in an Equip-Bid auction, you are legally bound to be charged for all won items and are agreeing to remove them from the auction location. No appointment necessary. Simply pick up your items during our standard pick-up times within 3 days of auction close (excluding Sunday).

If you are unable to pick up your item(s) within 3 business days, you MUST call 316-358-7212 with your bidder ID, BEFORE the deadline. We reserve the right to charge reasonable storage fees for time extensions. Storage fees, if imposed, will be 10% of the invoice total. The maximum hold extension is one week.

Acceptable methods of payment for your storage fee are cash or Credit Card. Note: you will NOT receive your item(s) until the storage fee is settled.

If you fail to pick up your item(s) and have not called by day 5, you will forfeit your item(s). They are put back on auction to be resold to the highest bidder. NO REFUNDS WILL BE GIVEN. Regardless of any agreed upon storage of your items, all invoices must be paid by the end of regular scheduled removal. You are still liable for paying for your item(s) and will be charged at the default credit card on file, whether or not you have picked up the item(s).

Removal: Once a bidder has paid for and picked up their items, the items become the property of the winning bidder (buyer). The buyer assumes all risk of loss and damage to property from that point forward, including at the premises of the sale.

Please come PREPARED to pick up your item(s). This means knowing your bidder ID, having a large enough vehicle. Be cognizant of the size and/or quantity of items you are picking up and BRING A HELPER if you have accumulated multiple invoices or have a large/heavy item.

If assistance from our staff is needed, we are not liable for any damage to the item(s) or the vehicle used. No refunds will be given if an item(s) is damaged during an assisted load-out.

Refunds: If you receive an item that is damaged, does not work, or is missing pieces and it was not listed as such in the description, you are eligible to apply for a refund. Photos are considered part of the item description. All refund requests must be submitted within 48 hours of picking up the item(s). If your request is approved, the item(s) must be returned WITHIN 2 business days (unless we have discussed otherwise) after the refund request was approved BEFORE a refund is issued. If you are returning an “Appears New” or “Factory Sealed” item, it must be returned BOXED in “Appears New” condition or we may charge a 20% restocking fee. Otherwise, no refund will be given as no warranty is expressed or implied. Please note that refunds are processed as soon as they are received but take 4-12 business days to process and return the money to your account.

Tax-Exempt Purchases: Tax-exempt forms must be provided to each independent affiliate—tax-exempt statuses are not stored with your Equip-Bid account. If this is your first tax-exempt purchase with Flex Wholesale LLC, please call 316-358-7212 to provide us with tax=exempt forms. Tax exempt documents must be in our possession before we remove sales tax. Invoices will not be adjusted once processed.

Liability: Flex Wholesale LLC's liability shall be limited to the refund of the bidder's purchase price.

Limitations: The above-stated Terms cannot be altered except in writing by Equip-Bid.
